Terms of Use

In short
This is a pre-launch website. Nothing is sold here yet. You can read about Evervel and join the Workshop Circle for monthly letters. Membership is free. You can leave at any time. Content and brand assets belong to Evervel. Portuguese law applies. If something goes wrong with our handling of your data, you can complain to the Portuguese supervisory authority.
1. About these terms
These Terms of Use ("Terms") are a legal agreement between you and Evervel, Unipessoal LDA, a Portuguese single-shareholder limited liability company (NIF 519 159 462), with registered office in Lisbon, Portugal ("Evervel", "we", "us", "our"). The Terms govern your use of evervel.com and any pages and services published under it (the "Site").
By using the Site or submitting your email to the Workshop Circle, you accept these Terms. If you do not accept them, please do not use the Site.
2. Who can use the Site
You may use the Site if you are at least 16 years old. The Workshop Circle is not directed to children. By submitting your email, you confirm you are 16 or older.
You may use the Site only in compliance with these Terms and applicable law.
3. The Workshop Circle
The Workshop Circle is a free email subscription. By submitting your email, you ask us to send you:
- A welcome email confirming your subscription.
- Our monthly Workshop Circle letter.
- Occasional pre-launch updates about Evervel (for example, when pre-orders open).
You can leave at any time, without giving a reason, by:
- Clicking the Unsubscribe link in any email we send you.
- Or writing to [email protected].
We may end your subscription at our discretion if we suspect abuse, fraud, or violation of these Terms. We may also pause or end the Workshop Circle as a whole, with reasonable advance notice to current members.
4. What we promise (and what we do not)
The Site is provided as is and as available. The information about future products is shared in good faith and reflects our current intent. It is not a commercial offer, a contract, or a promise that any specific product, feature, price, or date will be delivered. Plans change. We will keep our subscribers informed of material changes through the Workshop Circle.
We do not warrant that the Site will be uninterrupted, free of bugs, or available at all times. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Portuguese consumer-protection law.
5. Acceptable use
When you use the Site, you agree not to:
- Scrape, crawl, or systematically extract content beyond what is permitted by our robots.txt or by reasonable human use.
- Use the Site or any part of its content to train machine-learning or generative-AI systems without our prior written consent.
- Reverse-engineer, decompile, or attempt to obtain the source code of any non-public part of the Site.
- Submit false, misleading, or someone else's email address to the Workshop Circle.
- Probe, attack, or attempt to disrupt the Site, our hosting infrastructure, or our email infrastructure.
- Use the Site to send spam, malware, or unlawful content of any kind.
- Impersonate Evervel, our founder, or our team in any communication.
6. Intellectual property
All content on the Site, including text, photographs, schematic and 3D drawings, the wordmark "Evervel", the modular emblem, the colour and typography system, the React/JavaScript source code, and any other branded asset, is owned by Evervel, Unipessoal LDA or by its licensors, and is protected by copyright, trademark, and other intellectual-property laws.
You may view the Site in your browser and share links to it. You may quote short excerpts of text or screenshots in journalism, criticism, or commentary, with attribution to Evervel and a link back. Any other reproduction, redistribution, modification, or commercial use requires our prior written consent at [email protected].
AI-generated content. Content on the Site is written and reviewed by Evervel personnel. Where AI tools assist drafting, the final text is reviewed and approved before it is published, in line with the editorial-responsibility standard set by Article 50(4) of the EU AI Act. We do not knowingly publish unmodified AI-generated content or AI-generated images of real people.
7. Third-party links and services
The Site may link to third-party websites (for example, our Instagram and LinkedIn profiles). We do not control those sites and are not responsible for their content, terms, or privacy practices. Your use of any third-party site is at your own risk and subject to that site's own terms.
8. Limitation of liability
To the maximum extent permitted by Portuguese law, Evervel is not liable for any indirect, incidental, consequential, special, or punitive damage arising out of or related to your use of the Site, including loss of profits, business interruption, or loss of data, even if we were advised of the possibility of such damage.
Our total aggregate liability for any direct damage arising from the Site or these Terms is capped at one hundred euros (EUR 100), or the minimum amount that may be required by Portuguese consumer-protection law if higher.
This limitation does not apply to liability for death, personal injury, fraud, gross negligence, or any other liability that cannot be limited under Portuguese law.
9. Indemnification
You agree to defend and hold Evervel harmless from any third-party claim arising out of your unlawful or contractually breaching use of the Site, including reasonable legal fees, except where Evervel is itself responsible for the claim.
10. Changes to these Terms
We may update these Terms from time to time. The current version is published on this page. If we make a material change that affects your rights or obligations, we will publish the updated version with a new effective date and, if you are a Workshop Circle member, notify you by email at least fourteen (14) days before it takes effect. Continued use of the Site after the change means you accept the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of Portugal, without regard to its conflict-of-law rules.
Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, without prejudice to:
- Mandatory consumer-protection rules of your country of habitual residence (if you are an EU consumer).
- Your right, as an EU consumer, to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
- Your right to refer the matter to a Portuguese consumer arbitration centre (Centros de Arbitragem de Conflitos de Consumo) where one is competent.
12. Severability and entire agreement
If any provision of these Terms is found to be invalid or unenforceable, the rest remains in force, and the invalid provision is replaced by a valid provision that achieves a similar effect.
These Terms, together with the Privacy Policy, are the entire agreement between you and Evervel regarding the Site, and supersede any earlier or contemporary statement on the same subject.
